The business trading as QISAHN.COM (RCB No. 53098688D) unreservedly apologised to the Entertainment Software Association (“ESA”) and Nintendo Co., Ltd. and Nintendo of America Inc. (“Nintendo”), for having infringed Nintendo’s copyright and other relevant intellectual property rights in Nintendo’s products, including the Nintendo Wii, Nintendo Dual Screen / Dual Screen Lite game consoles (“Nintendo Game Consoles”) and Nintendo games (“Nintendo Games”) by:
1) having offered for sale and having sold: - devices which circumvent the technological security measures of Nintendo Game Consoles and Games (“Technological Measures”) to permit the play of illegal copies of Nintendo Games; - modified Nintendo Wii consoles which permit the play of illegal copies of Nintendo Games; and - illegal copies of Nintendo Games.
2) having offered and having provided services to modify Nintendo Wii game consoles to permit the play of illegal copies of Nintendo Games. QISAHN.COM acknowledges the harm caused by its illegal activities as described above regret its actions deeply.
QISAHN.COM undertakes not to further infringe Nintendo’s intellectual property rights nor those of any other member of ESA and not to circumvent, or distribute or offer for sale any devices that circumvent, the technological security measures that Nintendo or any other member of ESA may use with respect to its consoles or game software products to prevent the unauthorised use of such products.
QISAHN.COM understands that any further infringing activities on its part will subject its proprietor to criminal prosecution and penalties.
